These terms and conditions explain the basis on which Smart Play UK Ltd provides its services. Please read them carefully.
Inspiring Playgrounds

1. About Smart Play UK

Smart Play provides playground design, supply, installation, inspection and maintenance services for schools, nurseries, councils, community organisations and commercial clients.

These Terms & Conditions apply to all quotations, contracts and services provided by SmartPlay unless otherwise agreed in writing.

2. Quotations

All quotations are valid for 30 days from the date of issue unless otherwise stated.

Quotations are based on the information provided by the client at the time of enquiry. Any changes to the scope of works, specification, site conditions or project requirements may result in a revised quotation.

A quotation does not constitute a contract until accepted by the client and confirmed by SmartPlay.

3. Orders & Contracts

A contract is formed when a quotation is accepted in writing or when SmartPlay commences work on site.

All services are subject to SmartPlay's Standard Terms & Conditions and any project-specific agreements provided at the time of quotation.

4. Payment Terms

Payment terms will be specified within the quotation or contract documentation.

Invoices are payable within the agreed payment period stated on the invoice.

SmartPlay reserves the right to charge interest on overdue accounts in accordance with applicable legislation.

All prices are exclusive of VAT unless otherwise stated.

5. Installation & Project Timelines

Project timescales are provided in good faith and are subject to factors outside SmartPlay's reasonable control, including weather conditions, site access, material availability and third-party delays.

SmartPlay will make every reasonable effort to keep clients informed of any changes to project timelines.

6. Cancellations

If a project is cancelled after materials have been ordered or work has commenced, SmartPlay reserves the right to recover costs incurred up to the date of cancellation.

Any cancellation charges will be communicated to the client in writing.

7. Client Responsibilities

The client is responsible for:

  • Providing safe and suitable access to the site

  • Obtaining any permissions or approvals required for the works

  • Informing SmartPlay of any known site restrictions or hazards

  • Ensuring the site is available for the agreed works to proceed

Delays caused by the client may impact project timelines and costs.

8. Warranties

SmartPlay provides warranties on workmanship and supplied equipment in accordance with manufacturer warranties and contract documentation.

 

Warranties do not cover:

  •  Normal wear and tear                

  • Vandalism

  • Misuse 

  • Neglect

  • Lack of maintenance

  • Damage caused by third parties

9. Maintenance & Inspections

Regular inspections and maintenance are essential for the safe operation and longevity of playground equipment.

Inspection reports represent the condition of equipment at the time of inspection and should not be considered a guarantee of future condition or performance.

Further terms relating to maintenance packages and inspections are available upon request.

10. Liability

SmartPlay's liability shall be limited to the value of the services provided unless otherwise required by law.

Nothing within these Terms & Conditions shall limit liability where such limitation is prohibited by law.

11. Force Majeure

SmartPlay shall not be liable for any delay or failure to perform its obligations where such delay or failure arises from circumstances beyond its reasonable control, including but not limited to:

  • Adverse weather conditions

  • Supply chain disruptions

  • Industrial disputes

  • Government restrictions

  • Natural events

12. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
